本條款及細則的應用
本次活動參與者（下稱「考生」）一旦報名參與是次模擬試（下稱「活動」或「考試」），即表示清楚、明白下列條款，並同意受其約束。
活動詳情
本活動名稱為「二〇二四至二五年度迴享模擬試」，本活動擬於 2024 年 12 月 21 日於指定場地舉行，如場地或日期有所更改，迴享將於合理時間通知活動參與者。
活動贊助
考生知悉並同意本活動涉及第三方贊助。迴享將於活動舉行前、舉行期間和舉行後以若干形式（除電郵外）發放促銷或宣傳資訊；除考生所提供的 Instagram 帳號外，贊助商和第三方並不會獲悉考生之個人身份。
報名資格
活動只接受應屆（即 2025 年）香港中學文憑考試設計與應用科技科或中國文學科的獲邀全日制學校考生參與。迴享保留拒絕任何人參與是次活動而無須提供理由的權利。
免費報名條件
每位考生均須使用其 Instagram 帳號追蹤迴享（@dse.recurso）及贊助商（@fingerprint.hk）的 Instagram 帳號 ，並於《按金繳交證明上載表格》上附上已追蹤上述帳號的 Instagram 帳號名稱予迴享核實。
按金的收取
是次活動並非而牟利為目的，為確保資源的合理運用，每位考生均須自行繳交港幣二百元按金。
完成報名
報名表格應被視為「要約邀請」。迴享確認收到按金並向考生發送收據後，方被視作完成報名。活動名額有限，於完成報名前迴享不保證學生能參與是次活動。
按金的退還
一般而言，考生本人一旦完成報考科目的所有卷別，迴享將於活動完結後以現金全數退還按金；如迴享因惡劣天氣或不可抗力主動宣佈取消活動，迴享將退回按金。
☞ 按金的沒收
迴享於以下任何情況下，將不會向考生退還按金： (1) 考生缺席活動，不論其缺席理由；(2) 考生於完成報考科目所有試卷前離開；(3) 考生作弊、騷擾他人、擾亂試場秩序，或嚴重違反於香港考試評核局最新版本之《考試規則》及《考生手冊》所列明之考試規則。上述文件已刊於 https://www.hkeaa.edu.hk/tc/hkdse/admin/exam_regulations/ 、https://www.hkeaa.edu.hk/tc/hkdse/admin/student_s_handbook/ 中。
考試規則
考生須遵守香港考試及評核局最新版本之《考試規則》及《考生手冊》的規定，如考生嚴重違反上述規則，迴享保留拒絕考生繼續應考、將其驅離試場並沒收按金的權利。上述文件已刊於 https://www.hkeaa.edu.hk/tc/hkdse/admin/exam_regulations/ 、https://www.hkeaa.edu.hk/tc/hkdse/admin/student_s_handbook/ 中。
試卷的版權
所有試卷的版權歸迴享所有。任何人於複製試卷前須先取得迴享書面授權。
☞ 答卷的處理
所有申請人之答卷均屬迴享所有。迴享可按其認爲適當的時間和方法處理所有答卷；迴享亦可（及包括授權第三者）以不記名方式及在不披露考生身分的原則下使用、複製及／或出版上述答卷或其任何部份。迴享會合理謹慎地保管答卷，但倘有遺失或損毀，考生將放棄所有對迴享的申索（如有的話）。
成績的發放
迴享將於合理時間內以電郵發放考生的成績並將發放成績及意見，惟迴享不會發放「預計等級（Predicted Grade）」，考生只會獲得實際得分、百分位數及若干意見。迴享不對成績發放的格式和內容作任何保證。
個人資料的收集
迴享將收集考生個人資料，包括 (1) 學校名稱、(2) 考生姓名、(3) Instagram 用户名稱、(4) 電郵地址及 (5) 考生答卷。所有具辨別性的個人資料將於活動完結後銷毀，而迴享將收集並保存學校名稱、考生表現、評分數據，用於校本報告及數據分析中。迴享將於校本報告中包含所有參與是次活動的學校名單。迴享將於活動期間拍照或錄影，迴享及贊助商保留發佈影像作宣傳用途之權利。
☞ 免責條款
(1) 本次活動試題、答案、評改、評分、意見均僅供參考，並能不完全準確地反映中學文憑試中真實情況及考生實際能力，考生如因是次模擬試直接或間接影響最終考試表現，迴享恕不負責；(2) 迴享將竭盡所能確保試題題目準確無誤，惟迴享不能對此作任何保證，如發現任何疏漏，我們將儘快以廣播系統通知考生；(3) 如活動參與者於活動期間受傷，迴享不對其負上責任； (4) 活動參與者有責任保管個人物品，如遺失任何個人物品，迴享恕不負責。
惡劣天氣
當天文台於考試當日六時仍懸掛八號或以上的熱帶氣旋警告信號；或紅色或黑色暴雨警告時；或政府於當日六時仍宣佈「極端天氣狀態」時，本次活動將自動取消。
傳染病
如考生於模擬考前前確診傳染病，包括但不限於流行性感冒、2019 新型冠狀病毒病、肺炎支原體，考生不得出席是次活動，而迴享亦保留拒絕疑似確診者進入試場的權利，惟因上述理由未能應考者，迴享將不會對其退還按金。
不可抗力
迴享將盡可能按照上述日期及時間舉辦各場考試，惟並不保證全部考試均會如期舉行。對於因大範圍傳染病或疫情；恐怖襲擊、示威或暴動、社會動亂或公眾騷亂；爆炸、火災、自然災害或惡劣天氣；運輸、電訊、電力或其他公用事業的破壞、延誤、暫停或故障；勞資糾紛，包括但不限於抵制和罷工；檢疫措施或規限；海關或邊境管制；遵守任何法律或政府命令、規定、規則或指示；或任何超出迴享的控制，以致迴享未能履行部分或全部合約義務的情況或原因引起的任何延誤、不履約、索賠、投訴或爭議，迴享將不會承擔任何責任。在上述任何情況下，除退還按金外，迴享將不會承擔任何費用支出、退款或其他損失的責任。
法律及司法管轄權的選擇
本條款及細則須受香港特別行政區法律規限並據此詮釋。任何因本條款及細則而引起的爭議均受香港特別行政區法院的專有司法管轄權管轄。
完整協議
本條款及細則構成雙方就協議事項達成的完整協議和理解，並取代與協議事項相關的所有宣傳品、口頭通訊及先前文書。
最終決定權
如有因本活動或本條款及細則所引發的任何爭議，迴享保留最終決定權。
解釋權
迴享保留一切對本條款及細則的最終解釋權，如您對上述條款及細則抱有任何疑問，請以電郵聯絡 [email protected]。

Application of these terms and conditions
Upon registration for this mock test (hereinafter referred to as “Activity” or “Exam”), the participants (hereinafter referred to “Candidates”) undertake that they understand and agree to be bound by the following terms.
Activity details
The name of this activity is “Recurso Mock Exam 2024–25”. The activity is tentatively scheduled to take place on 21 December, 2024, at designated venue. If the venue or date changes, Recurso will notify the participants within reasonable time.
Activity sponsorship
Candidates acknowledge and agree that this activity involves third-party sponsorship. Recurso may distribute promotional or advertising information in various forms (except email) before, during and after the activity. Any sponsor and third party will not obtain the personal identity of the candidates from Recurso, save and except for the Instagram accounts provided by candidates.
Eligibility
The activity only accepts full-time school candidates from invited secondary school who are taking the Design and Applied Technology or Chinese Literature in the 2025 Hong Kong Diploma of Secondary Education Examination. Recurso reserves the right to reject anyone from participating in this activity without providing a reason.
Free registration condition
Each candidate must use their Instagram account to follow Recurso (@dse.recurso) and the sponsor (@fingerprint.hk) on Instagram and provide the names of the Instagram accounts that have followed the above accounts for verification by Recurso on the “Deposit Payment Verification Form”.
Deposit collection
This is a non-profit activity. To ensure the reasonable use of resources, each candidate must pay a deposit of HK$200.
Registration completion
The application form should be considered as an “invitation to treat”. The registration is considered complete only when Recurso confirms receipt of the deposit and sends a receipt to the candidate. The quota for the activity is limited, and Recurso does not guarantee that participants can participate in this activity before completing registration.
Deposit refund
Generally speaking, once the candidate has completed all subjects of the exam, Recurso will refund the deposit in full in cash after the activity ends; if Recurso cancels the activity due to inclement weather or force majeure, Recurso will refund the deposit.
☞ Forfeiture of deposit
Recurso will not refund the deposit to candidates under any of the following circumstances: (1) The candidate is absent from the activity, regardless of the reason for absence; (2) The candidate leaves before completing all the exam papers of the subjects they registered for; (3) The candidate cheats, harasses others, disrupts the order of the exam, or any other serious violation of the exam rules listed in the latest versions of the “Exam Regulations”, and “Student’s Handbook” by the Hong Kong Examinations and Assessment Authority. Exam rules
Candidates must comply with the latest versions of the “Exam Regulations”, and “Student’s Handbook” by the Hong Kong Examinations and Assessment Authority. If a candidate commits a serious violation of the “Exam Regulations” , Recurso reserves the right to refuse the candidate to continue the exam, expel them from the exam venue, and forfeit their deposit. Copyright of exam papers
All rights to the exam papers belong to Recurso. Anyone must obtain written authorization from Recurso before reproducing the exam papers.
☞ Handling of answer scripts
All answer scripts belong to Recurso. Recurso may handle all answer scripts at its discretion and in its own time and manner; Recurso may also (including authorising a third party) use, reproduce and/or publish the above-mentioned answer scripts or any part thereof in an anonymous manner and without disclosing the candidate’s identity. Recurso will take reasonable care of the answer scripts, but if they are lost or damaged, the candidate will waive all claims against Recurso (if any).
Release of results
Recurso will release the results and comments by email within a reasonable time, but Recurso will not release a “Predicted Grade”, and candidates will only receive actual scores, percentile ranks, and some comments. Recurso does not guarantee the format and content of the results release.
Procession of personal data
Recurso will collect the candidates’ personal data, including (1) school name, (2) candidate name, (3) Instagram username, (4) email address, and (5) candidate’s answer script. All identifiable personal data will be destroyed after the activity ends, and Recurso will collect and keep the school name, candidate performance, and scoring data for school reports and data analysis. Recurso will include the names of all schools participating in this activity in the school report. Recurso will take photos or videos during the activity, and Recurso and the sponsor reserve the right to publish the images for promotional purposes.
☞ Disclaimer
(1) The exam questions, answers, marking, grading, and comments in this activity are for reference only, and may not accurately reflect the actual situation in the Diploma of Secondary Education Examination and the actual ability of the candidates. Recurso is not responsible if this mock exam directly or indirectly affects the final exam performance of the candidates; (2) There is no guarantee of the accuracy of the exam questions. If any error is found,, we will notify the candidates in reasonable time through the broadcast system; (3) Recurso shall not be liable for any personal injuries suffered by participants in the course of the activity; (4) Participants are responsible for keeping their personal belongings. Recurso shall not be liable if any personal belongings are lost.
Extreme weather
If a No.8 or above typhoon warning signal, or a red or black rainstorm warning, is issued by the Hong Kong Observatory at 6 a.m. on the exam day, the event will be cancelled.
Infectious diseases
Candidates diagnosed with an infectious disease before the mock exam, including but not limited to influenza, COVID-19, or Mycoplasma pneumonia, must not attend this activity. Recurso reserves the right to prevent candidates who are suspected to be suffering from infectious disease from entering the exam venue. However, Recurso will not refund the deposit to candidates who cannot take the exam due to the above reason.
Force majeure
Although Recurso will endeavour to ensure that all examinations will be conducted in the venue, on the dates and at the times as specified, it cannot guarantee that this will be so. Recurso will also not be liable for any delay, non-performance, claim, complaint or dispute arising from circumstances or causes such as epidemic or pandemic, terrorist attack, demonstrations or riots, social unrest or public disorder; explosion, fire, natural disasters or inclement weather conditions; destruction, suspension, unavailability or break-down of transport, telecommunication, electricity or other public utility; labour disturbance including but without limitation to boycott and strike; quarantine measures or restrictions; immigration or border controls; compliance with any law or governmental order, rule, regulation or direction; or any event beyond the control of Recurso. In any of the above situations, apart from returning the deposit, Recurso will not be liable for any costs, refunds or other losses.
Choice of law and jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
Entire Agreement
These terms and conditions embody the entire Contract between the parties hereto concerning the subject matter hereof and supersedes all prior publications, conversations, proposals, negotiations, understandings and contracts, whether written or oral.
Final decision
Recurso reserves the final decision in any dispute arising from this activity or these terms and conditions.
Interpretation
In case of any discrepancy in the meaning of wording between the English text and the Chinese text, the Chinese version shall prevail.
