釋義
在本條款及細則內，除非文意另有不同之外，下列字詞應帶有下列文意：
「報名人」
報名參加迴享模擬試 2025/26 的學生；
「考生」
迴享模擬試 2025/26 的參加者；
「資助機構」
迴享模擬試 2025/26 的資助人，即香港特別行政區政府及香港特別行政區社創基金；
「指明資格」
曾或現居住於劏房、公共房屋或過渡性房屋；或現領取綜援、車船津貼、書簿津貼或上網費津貼計劃；或有特別經濟需要的學生；
「模擬考試」
迴享模擬試 2025/26；
「合約各方」
迴享有限公司、報名人、考生及負責老師；
「迴享」
迴享有限公司；
「負責老師」
代表報名人和學校報名和跟進模擬試事宜的老師；
「贊助商」
迴享模擬試 2025/26 的贊助商，即Fingerprint Limited。
本條款及細則的應用
申請人一旦報名參與是次模擬考試，即表示清楚、明白下列條款，並同意受其約束。
活動詳情
本模擬考試名稱為「迴享模擬試 2025/26」。本模擬考試擬於 2025 年 12 月 20 至 23 日間的指定時間於指定場地舉行，如場地或日期有所更改，迴享將於合理時間通知考生。
活動贊助
考生知悉並同意本模擬考試涉及若干第三方贊助及資助。迴享、贊助商及資助機構將於模擬考試舉行前、舉行期間和舉行後以若干形式發放促銷或宣傳資訊。
報名資格
(1) 本模擬考試只接受報考 2026 年香港中學文憑考試並選修「設計與應用科技科」、中國文學科、歷史科或「資訊及通訊科技科」的獲邀全日制學校考生參與。
(2) 報名人必須透過其學校或負責老師報名。
(3) 每位報名人必須在 2025 年 9 月 30日或之前填妥報名表格，並通過其學校或負責老師將報名表格提交予迴享。
(4) 每位報名人均須使用其 Instagram 帳號追蹤迴享及贊助商的 Instagram 帳號（即 @dse.recurso 、@meow.recurso 及 @fingerprint.hk），並於考前問卷中附上已追蹤上述帳號的 Instagram 帳號名稱予迴享核實。
(5) 報名人須於模擬考試前後完成所有迴享指定的問卷。
(6) 報名人不得於是次活動報考超過一科。
(7) 迴享保留拒絕任何人參與是次模擬考試而無須提供理由的權利。
按金的收取
是次模擬考試並非以牟利為目的，為確保資源的合理運用，每位考生均須透過其學校或負責老師於報名時繳交港幣三百元按金。迴享保留酌情豁免個別考生的按金之權利。
完成報名
報名表格應被視為「要約邀請」。迴享確認收到按金並向考生發送確認電郵後，方被視作完成報名。活動名額有限，於完成報名前迴享不保證報名人能參與是次模擬考試。
按金的退還
考生一旦完成報考科目的所有卷別，迴享將於模擬考試完結後以現金全數退還按金；如迴享因惡劣天氣或不可抗力主動宣佈取消模擬考試，迴享將退回按金。
☞ 按金的沒收
迴享於以下任何情況下，將不會向考生退還按金：
(1) 考生缺席模擬考試，不論其缺席理由；
(2) 考生於完成報考科目所有試卷前離開；
(3) 考生作弊、騷擾他人、擾亂試場秩序，或嚴重違反於香港考試評核局最新版本之《考試規則》及《考生手冊》所列明之考試規則。上述文件已刊於 https://www.hkeaa.edu.hk/tc/hkdse/admin/exam_regulations/ 、https://www.hkeaa.edu.hk/tc/hkdse/admin/student_s_handbook/ 中。
考試規則
考生須遵守香港考試及評核局最新版本之《考試規則》及《考生手冊》的規定，如考生嚴重違反上述規則，迴享保留拒絕考生繼續應考、將其驅離試場並沒收按金的權利。
☞ 試卷的版權
所有試卷和答卷的版權歸迴享所有。
☞ 答卷的處理
所有考生之答卷均屬迴享所有。迴享可按其認為適當的時間和方法處理所有答卷；迴享亦可（及包括授權第三者）以不記名方式及在不披露考生身分的原則下使用、複製及／或出版上述答卷或其任何部份。迴享會合理謹慎地保管答卷，但倘有遺失或損毀，考生將放棄所有對迴享的申索（如有的話）。
成績的發放
迴享將於合理時間內以電郵發放考生的成績及評語，惟迴享不會發放「預計等級（Predicted Grade）」，考生只會獲得實際得分、百分位數及若干評語。迴享不對成績發放的格式和內容作任何保證。
☞ 收集個人資料聲明
(1) 通過報名表格、活動期間的問卷、答卷收集的資料，包括但不限於學校名稱、姓名、Instagram 用户名稱、報名人家庭財政狀態、電郵地址、答案及成績、問卷答案和模擬考試期間的照片或錄像，將用於處理模擬考試報名、行政、溝通、評改試卷、發放成績、統計、數據分析、教育和宣傳。
(2) 提供上述資料純屬自願，但如果報名人沒有提供上述資料，迴享將不能接受報名人的報名。
(3) 所有具辨別性的個人資料將於模擬考試完結後的合理時間內銷毀。迴享將繼續保存其它資料，包括但不限於學校名稱、考生表現、評分數據、問卷數據，用於校本報告及數據分析等迴享認為為合適的用途，上述用途將不會暴露任何個人身份。
(4) 為認證符合贊助資格、進行績效評估及宣傳，報名人的個人資料有機會會被轉移至贊助商（僅限 Instagram 用户名稱）及資助機構。
(5) 除了《個人資料（私隱）條例》（香港法例第 486 章）規定的豁免範圍及本條第（4）款的例外，報名人提供的個人資料將不會向與本模擬考試試無關的人士披露。
(6) 根據《個人資料（私隱）條例》（香港法例第 486 章），報名人有權要求查閱及改正報名人提供的資料。報名人的查閱權利包括以迴享所定的費用，索取報名人的資料的複本。
(7) 如對個人資料的收集有任何查詢，包括要求查閱和改正資料，可與迴享聯絡（電郵： [email protected]）。
(8) 迴享將於校本報告中包含所有參與是次模擬考試的學校名單。
(9) 負責老師將會獲得考生答卷和模擬試成績副本。
負責老師的通訊偏好
(1) 負責老師同意迴享收集負責老師的聯絡方式，即負責老師的 (i) 電郵地址， (ii) 姓名、(iii) 職稱、 (iv) 任教學校、及 (v) 電話號碼。
(2) 迴享將會於保留和使用上述資料作是次模擬考試的溝通事宜及宣傳未來的模擬試活動。
(3) 如負責老師反對迴享保留和使用聯絡方式作上述用途，負責老師應向 [email protected] 提出書面通知。
☞ 免責條款
(1) 本次模擬考試的試題、答案、評改、評分、評語均僅供參考，並不能完全準確地反映中學文憑試中真實情況及考生實際能力，考生如因是次模擬考試直接或間接影響最終考試表現，迴享恕不負責；
(2) 迴享將竭盡所能確保試題題目準確無誤，惟迴享不能對此作任何保證，如發現任何疏漏，迴享將在合理時間內通知考生；
(3) 如考生於活動期間受傷，迴享不對其負上責任；
(4) 考生有責任保管個人物品，如遺失任何個人物品，迴享恕不負責。
惡劣天氣
當天文台於考試當日七時仍懸掛八號或以上的熱帶氣旋警告信號；或紅色或黑色暴雨警告時；或政府於當日七時仍宣佈「極端天氣狀態」時，本次模擬考試將自動順延或取消。如遇到上述情況，迴享將以電郵通知考生最新安排。
☞ 傳染病
如考生於活動前確診傳染病，包括但不限於流行性感冒、2019 新型冠狀病毒病、肺炎支原體，考生不得出席是次模擬考試，而迴享亦保留拒絕疑似確診者進入試場的權利，惟因上述理由未能應考者，迴享將不會對其退還按金。
不可抗力
迴享將盡可能按照上述日期及時間舉辦各場考試，惟並不保證全部考試均會如期舉行。對於因大範圍傳染病或疫情；恐怖襲擊、示威或暴動、社會動亂或公眾騷亂；爆炸、火災、自然災害或惡劣天氣；運輸、電訊、電力或其他公用事業的破壞、延誤、暫停或故障；勞資糾紛，包括但不限於抵制和罷工；檢疫措施或規限；海關或邊境管制；遵守任何法律或政府命令、規定、規則或指示；或任何超出迴享的控制，以致迴享未能履行部分或全部合約義務的情況或原因引起的任何延誤、不履約、索賠、投訴或爭議，迴享將不會承擔任何責任。在上述任何情況下，除退還按金外，迴享將不會承擔任何費用支出、退款或其他損失的責任。
法律及司法管轄權的選擇
本條款及細則須受香港特別行政區法律規限並據此詮釋。任何因本條款及細則而引起的爭議均受香港特別行政區法院的專有司法管轄權管轄。
完整協議
本條款及細則構成合約各方就協議事項達成的完整協議和理解，並取代與協議事項相關的所有宣傳品、口頭通訊及先前文書。
最終決定權
如有因本模擬考試或本條款及細則所引發的任何爭議，迴享保留最終決定權。
解釋權
迴享保留一切對本條款及細則的最終解釋權，如您對上述條款及細則抱有任何疑問，請以電郵聯絡 [email protected]。

Interpretation
In this Terms and Conditions, the following expressions shall have the meanings set out below unless the context requires otherwise:
“Applicant”
Student applying to participate in the Recurso Mock Exam 2025/26;
“Candidate”
Student applying to participate in the Recurso Mock Exam 2025/26;
“Funding Party”
The funding party of Recurso Mock Exam 2025/26, which is the HKSAR Government and the Trustee of Social and Innovation Entrepreneurship Development Fund;
“Specified Eligibility”
Students who have previously or currently lived in subdivided units, public housing, or transitional housing; or who are currently receiving Comprehensive Social Security Assistance (CSSA), transport subsidies, textbook subsidies, or internet fee subsidy schemes; or students with special financial needs;
“Mock Exam”
Recurso Mock Exam 2025/26;
“Parties”
Recurso Limited, the Applicants, the Candidates and the Responsible Teachers;
“Recurso”
Recurso Limited;
“Responsible Teachers”
The teacher(s) who, on behalf of the school and the applicants, processes application, follow-up work of the Mock Exam;
“Sponsor”
The sponsor of Recurso Mock Exam 2025/26, which is Fingerprint Limited.
Application of Terms and Conditions
Upon registration for this Mock Exam, the Applicants undertake that they understand and agree to be bound by the following terms.
Activity details
The name of this Mock Exam is “Recurso Mock Exam 2025/26”. The Mock Exam is tentatively scheduled to take place between 20th to 23rd December 2025, at a designated venue. If the venue or date changes, Recurso will notify the Candidates within reasonable time.
Activity sponsorship
Candidates acknowledge and agree that this Mock Exam involves third-party sponsorship and funding. Recurso, Sponsor and Funding Party may distribute promotional or advertising information in various forms before, during and after the Mock Exam.
Eligibility
(1) The Mock Exam only accepts full-time students from invited secondary schools who are taking History, Information and Communication Technology, Design and Applied Technology or Chinese Literature in the 2026 Hong Kong Diploma of Secondary Education Examination as Candidates.
(2) Applicants must register the activity through the Applicant’s school or Responsible Teacher(s).
(3) Each Applicant must complete the application form before the deadline, which is on or before 30 September 2025, and submit the completed application form to Recurso through the Applicant’s school or Responsible Teacher(s).
(4) Each Applicant must use their Instagram account to follow Recurso and the Sponsor (i.e. @dse.recurso , @meow.recurso AND @fingerprint.hk) on Instagram and provide the username of the Instagram accounts that have followed the above accounts to Recurso in the pre-exam questionnaire for verification.
(5) Applicants are required to finish all questionnaires required by Recurso, distributed before and after the Mock Exam.
(6) Applicants may only apply for no more than 1 subject in this Mock Exam.
(7) Recurso reserves the right to reject anyone from participating in this activity without providing a reason.
Deposit collection
This is a non-profit activity. To ensure the reasonable use of resources, each Candidate must pay a deposit of HK$300 via his/her school or the Responsible Teacher(s). Recurso may waive the deposit for individual Candidates on a discretionary basis.
Completion of Registration
The application form should be considered as an “invitation to treat”. The registration is considered complete only when Recurso confirms receipt of the deposit and sends a confirmation email to the Candidate. The quota for the activity is limited, and Recurso does not guarantee that Applicants can participate in this activity before the completion of the registration.
Deposit refund
Once the Candidate has completed all the exam papers of the subjects he/she registered for, Recurso will refund the deposit in full in cash after the Mock Exam ends; if Recurso cancels the Mock Exam due to inclement weather or force majeure, Recurso will refund the deposit.
☞ Forfeiture of deposit
Recurso will not refund the deposit to Candidates under any of the following circumstances:
(1) The Candidate is absent from the Mock Exam, regardless of the reason for absence;
(2) The Candidate leaves before completing all the exam papers of the subjects he/she registered for;
(3) The candidate cheats, harasses others, disrupts the order of the Mock Exam, or any other serious violation of the exam rules listed in the latest versions of the “Exam Regulations”, and “Student’s Handbook” by the Hong Kong Examinations and Assessment Authority. Exam rules
Candidates must comply with the latest versions of the “Exam Regulations”, and “Student’s Handbook” by the Hong Kong Examinations and Assessment Authority. If a Candidate commits a serious violation of the “Exam Regulations” , Recurso reserves the right to refuse the Candidate to continue participating in the Mock Exam, expel them from the exam venue, and forfeit their deposit.
☞ Copyright of exam papers
All rights to the exam papers and answer script belong to Recurso.
☞ Handling of answer scripts
All answer scripts belong to Recurso. Recurso may handle all answer scripts at its discretion and in its own time and manner; Recurso may also (including authorising a third party) use, reproduce and/or publish the above-mentioned answer scripts or any part thereof in an anonymous manner and without disclosing the Candidate’s identity. Recurso will take reasonable care of the answer scripts, but if they are lost or damaged, the Candidate will waive all claims against Recurso (if any).
Release of results
Recurso will release the results and comments by email within a reasonable time. However, Recurso will not release a “Predicted Grade”, and Candidates will only receive actual scores, percentile ranks, and comments. Recurso does not guarantee the format and content of the release of results.
☞ Personal Information Collection Statement
(1) The data collected by means of the application form, questionnaire and answer scripts, including but not limited to school name, name, Instagram username, financial status of the Applicant’s family, email address, answer script and exam result, answers in the questionnaire, and photos and recordings taken during the Mock Exam, will be used for the purposes of Mock Exam registration, administration, communication, script marking and scoring, statistics, data analysis, education and promotion.
(2) The provision of the said data is voluntary. However, if the Applicant does not provide the said data, Recurso will not be able to process the Applicant’s application to this Mock Exam.
(3) All identifiable personal data will be destroyed within a reasonable time after the end of the Mock Exam. After the Mock Exam ends, Recurso may keep other collected information, including but not limited to school name, candidate performance, scoring data and questionnaire data for school reports, data analysis or any purpose that Recurso thinks is appropriate and that does not expose any personal identity.
(4) To verify the eligibility for joining this free Mock Exam event, to measure and to assess the impact and key performance indicators of this Mock Exam, and for promotional purposes, Applicants’ personal data may be transferred to the Sponsor (Instagram usernames only) and Funding Party.
(5) The personal data provided by the Applicant will not be disclosed to any irrelevant party, subject to the exemptions provided under section (4) in this clause, and the Personal Data (Privacy) Ordinance, (Cap. 486).
(6) The Applicant has a right of access and correction with respect to the personal data he/she has provided in accordance with the Personal Data (Privacy) Ordinance (Cap. 486). The Applicant’s right of access includes the right to obtain a copy of his/her personal data held by the Scheme subject to payment of a fee at such rate as shall be promulgated by Recurso.
(7) Enquiries concerning the collection of personal data, including requests for access to and correction of data, should be directed to Recurso ([email protected]).
(8) Recurso will include the names of all schools participating in this activity in the school report.
(9) Responsible teachers will have access to the candidate’s answer script and Mock Exam result.
Communication Preference of Responsible Teacher
(1) The Responsible Teachers is presumed to agree that Recurso collects the contact information of the Responsible Teachers, which include (i) email address, (ii) name, (iii) title (iv) school and (v) telephone number.
(2) Recurso will retain and use the above information for the purpose of communication regarding this Mock Exam and promotion of future mock exam activity,
(3) Should the Responsible Teacher refuse the retainment and the usage of the information for the above purpose, a written refusal should be provided to [email protected].
☞ Disclaimer
(1) The exam questions, answers, marking, grading, and comments in this Mock Exam are for reference only, and may not accurately reflect the actual situation in the Diploma of Secondary Education Examination and the actual ability of the candidates. Recurso is not responsible if this Mock Exam directly or indirectly affects the final exam performance of the Candidates;
(2) There is no guarantee of the accuracy of the exam questions. If any error is found, Recurso will notify the candidates in reasonable time;
(3) Recurso shall not be liable for any personal injuries suffered by Candidates in the course of this Mock Exam;
(4) Candidates are responsible for keeping their personal belongings. Recurso shall not be liable if any personal belongings are lost.
Extreme weather
If a No.8 or above typhoon warning signal, or a red or black rainstorm warning, is issued by the Hong Kong Observatory at 7 a.m. on the exam day, the Mock Exam will be postponed or cancelled. Recurso will notify Candidates of the newest arrangement in case of extreme weather via email.
☞ Infectious diseases
Candidates diagnosed with an infectious disease before the activity, including but not limited to influenza, COVID-19, or mycoplasma pneumonia, must not attend this Mock Exam. Recurso reserves the right to prevent Candidates who are suspected to be suffering from infectious disease from entering the exam venue. However, Recurso will not refund the deposit to Candidates who cannot take the exam due to the above reason.
Force majeure
Although Recurso will endeavour to ensure that all examinations will be conducted in the venue, on the dates and at the times as specified, it cannot guarantee that this will be so. Recurso will also not be liable for any delay, non-performance, claim, complaint or dispute arising from circumstances or causes such as epidemic or pandemic, terrorist attack, demonstrations or riots, social unrest or public disorder; explosion, fire, natural disasters or inclement weather conditions; destruction, suspension, unavailability or break-down of transport, telecommunication, electricity or other public utility; labour disturbance including but without limitation to boycott and strike; quarantine measures or restrictions; immigration or border controls; compliance with any law or governmental order, rule, regulation or direction; or any event beyond the control of Recurso. In any of the above situations, apart from returning the deposit, Recurso will not be liable for any costs, refunds or other losses.
Choice of law and jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
Entire Agreement
These terms and conditions embody the entire Contract between the Parties hereto concerning the subject matter hereof and supersedes all prior publications, conversations, proposals, negotiations, understandings and contracts, whether written or oral.
Final decision
Recurso reserves the final decision in any dispute arising from this Mock Exam or these Terms and Conditions.
Interpretation
In case of any discrepancy in the meaning of wording between the English text and the Chinese text, the Chinese version shall prevail.
